• By placing an order, accepting the order confirmation or making a purchase via the website, the customer accepts these Terms and Conditions.
2. Prices
• All prices are quoted in Swiss francs (CHF) and exclude VAT, unless otherwise stated. • We reserve the right to make changes to prices and technical specifications.
3. Delivery and delivery times
• Items in stock are usually delivered within 7 to 14 days. • For products not held in stock, the delivery times stated or delivery times provided on request apply. • Delivery dates and lead times are non-binding estimates. • Delays caused by production, transport, customs clearance, force majeure or supply bottlenecks do not entitle the customer to withdraw from the contract or to claim damages.
4. Installation and infrastructure
• The customer shall ensure that the requirements for delivery and installation are met. • In particular, the customer must provide: -Access to the installation site -Power supply -Wi-Fi or internet connection -network connections, if required • mybow does not carry out electrical installations. • Any missing requirements or additional work may be charged separately. • Installations within a 50 km radius of 6005 Lucerne are included in the BUSINESS packages. • Additional costs arising from unusual installation conditions, difficult access or delays on the customer’s part may be charged separately.
5. Terms of payment
BASIC • 100 % prepayment
BUSINESS • 50 % deposit payable upon ordering • 50 % Final payment on delivery or installation
• Invoices are payable within 10 days. • The goods remain the property of mybow gmbh until full payment has been received.
6. Software and content
• The point-to-point software is included in the relevant package. • Optional services such as PRO Software, Premium Care, Premium Content or other services will be charged in accordance with the current price list. • The creation, maintenance and updating of content is generally the responsibility of the customer, unless additional content services have been commissioned from mybow. • mybow does not guarantee the uninterrupted availability of software, cloud or app services.
7. Subscriptions
• Premium Care, PRO Software and other subscriptions are billed annually. • Subscriptions are automatically renewed for a further 12 months unless they are cancelled in writing at least 30 days before the expiry date.
8. Warranty
• mybow provides a warranty on the devices supplied of 12 months from the delivery date. • The warranty is limited, at mybow’s discretion, to: - Repair - Replacement delivery - Refund of the purchase price • About the warranty excluded are, in particular: -improper use -Damage caused by falling or during transport -Vandalism -Theft -weather conditions -Overvoltage -Damage caused by force majeure -normal wear and tear • The warranty covers only the device supplied. Installation, network connections, third-party software and the customer’s infrastructure are not covered by the warranty. No further claims shall be accepted.
9. Outdoor equipment
• The customer is responsible for ensuring that the equipment is positioned, secured and operated safely. • mybow accepts no liability for damage caused by wind, storms, vandalism, theft, improper use or external factors.
10. Authorisations
• Depending on the location, local authority or canton, permits or specific requirements may be necessary for digital advertising displays, pavement signs, displays or other advertising media. • It is the customer’s sole responsibility to ascertain, obtain and comply with all official permits and regulations. • mybow accepts no liability in this regard.
11. Liability
• mybow shall only be liable for damage caused by wilful misconduct or gross negligence. • We accept no liability whatsoever for indirect or consequential losses, loss of data, business interruption, loss of profit or loss of revenue. • Liability is limited in all cases to the value of the order.
12. Data Protection
• Personal data is processed solely for the purpose of fulfilling the contract and will not be disclosed to third parties without the customer’s consent, unless there is a legal obligation to do so.
13. Jurisdiction
• Swiss law applies exclusively. • The place of jurisdiction for all disputes is Lucerne, Switzerland.
